These Terms of Service ("Terms") govern your use of SmarteRadio — the smarteradio.com website, the per-country white-label radio apps, and the Smart TV apps (collectively, the "Service"). SmarteRadio is a free service that lets you listen to publicly broadcast live radio, with no account required. By using the Service, you agree to these Terms.
1. Acceptance of these terms
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Service. We may update these Terms from time to time as described in §8; your continued use after an update means you accept the revised Terms.
2. The Service
SmarteRadio is a Smart TV and web radio platform that lets you discover and play live radio broadcasts from stations around the world, grouped by country, and that pairs the live "now playing" track with short, automatically generated notes about the song. Key things to know:
- It's free. There is no subscription, trial, or fee, and we do not run advertising in the apps.
- No account. The listening apps require no sign-up, login, or personal details.
- We aggregate, we don't broadcast. SmarteRadio is a directory and player for radio streams operated by third-party broadcasters. We do not own, originate, control, or guarantee the audio content of any station.
- Provided "as is". The Service is provided on an "as is" and "as available" basis (see §9).
3. Eligibility
The Service is intended for a general audience and is not directed at children. By using the Service you confirm you are able to form a binding agreement in your jurisdiction, or that you are using it under the supervision of a parent or guardian who agrees to these Terms. If you use the Service on behalf of an organisation, you represent that you are authorised to accept these Terms for that organisation.
4. Acceptable use
You agree to use the Service only for lawful, personal, non-commercial listening. In particular, you agree not to:
- Use the Service in violation of any applicable law or third-party right, including broadcasters' rights and any local rules on accessing or recording broadcasts;
- Copy, record, redistribute, rebroadcast, or commercially exploit any stream or content delivered through the Service, except where expressly permitted by the rights holder;
- Attempt to scrape, mirror, or systematically extract the station directory, metadata, or any part of the Service for use in a competing product;
- Interfere with, overload, probe, or attempt to gain unauthorised access to the Service, our infrastructure, or third-party stream hosts (including denial-of-service activity, automated abuse, or circumventing rate limits or security controls);
- Reverse engineer, decompile, or tamper with the apps except to the extent this restriction is prohibited by applicable law;
- Use the Service to transmit malware or to misrepresent your identity or affiliation with SmarteRadio.
5. Third-party streams & content
The radio streams, station logos, programming, music, news, and other content you hear or see are provided by independent third-party broadcasters and content providers. SmarteRadio does not control and is not responsible for that content, its accuracy, legality, or availability. Stations may change, relocate, or stop broadcasting at any time, and a stream's availability through the Service depends on the broadcaster. Your use of any third-party stream may also be subject to that broadcaster's own terms.
6. AI-generated song insights
The short "song insight" notes shown alongside the now-playing track are generated automatically using AI based only on the song's artist and title. These notes are provided for general interest and entertainment only. They may be inaccurate, incomplete, or out of date, and should not be relied upon as factual or professional information.
7. Intellectual property
The SmarteRadio name, logo, software, design, and the original elements of the Service are owned by the operator (Desoline) and protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial listening, subject to these Terms. We grant you no rights in the underlying broadcasts or in any station's trademarks, logos, or content, which remain the property of their respective owners.
8. Availability & changes
We work to keep the Service available, but we may modify, suspend, or discontinue any part of it — including stations, features, or the AI insights — at any time and without notice, and we may impose limits on certain features or restrict access. We are not liable for any unavailability of, or change to, the Service. We may also update these Terms from time to time; when we make material changes we will update the "Last updated" date above, and the current version is always available at smarteradio.com/terms/.
9. No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. We do not warrant that any station, stream, or insight will be available, accurate, lawful in your location, or free of interruption. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you; in that case, any mandatory consumer rights you have under local law are not affected.
10. Limitation of liability
To the maximum extent permitted by applicable law, the operator and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service, the content delivered through it, or these Terms. Because the Service is provided free of charge, to the extent a liability cannot be excluded, it is limited to the greatest extent permitted by law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
11. Governing law
These Terms, and any dispute arising out of or relating to them or to the Service, are governed by the laws applicable to Desoline as the operator of the Service, without regard to conflict-of-law rules, and are subject to the jurisdiction of the competent courts of the operator's place of establishment. This does not deprive you of any protection afforded by mandatory consumer-protection laws of your country of residence.
